It is extremely difficult to put a price indication on Employment Tribunal proceedings as fees are entirely dependent on whether the claim progresses all the way to final Hearing, or whether it settles throughout proceedings. Fees will also be determined by the complexity of the claim, for example, an unfair dismissal claim with a multi discriminatory aspects could be five times the cost of a straight forward Unfair Dismissal claim. The below provides rough indication of cost estimates for various different Employment Tribunal actions however, all cases are different and final cost information can only be provided once the complexity of the case is known. In addition to the time spent, we may take into account a number of factors which include the complexity of the issues, the speed at which action must be taken and the expertise or specialist knowledge that the case requires.

ACAS Early Conciliation– to initiate, conduct and conclude ACAS Early Conciliation prior to Tribunal action would normally cost between £440 – £660 + vat.
ET1 / ET3 Preparation – depending on documents involved and facts of the matter costs will range from £440 – £1,540 + vat
Tribunal Proceedings for Unfair & Wrongful dismissal – based on preparation of evidence, Hearing Bundle of documents, witness statements and one Hearing- £5,000 – £25,000 depending on the nature of the claim, documents involved, number of witnesses and Directions set by the Tribunal.
Costs will increase if additional Hearings are necessary such as, Case Management and Preliminary Hearings. Cases involving discriminatory claims will mean an increase in fees. The above estimate do not include third party disbursements such as Barristers costs and expert opinions. The above fees are based on an experienced Employment Lawyer conducting your matter, reduced hourly rates are in place for Paralegals.
Generally speaking costs do not follow the event in Employment Tribunal proceedings therefore, even if you are successful in brining or defending the claim, it is unlikely that you will recover your costs. Legal costs will therefore play a big part in our advice to you to ensure pursuing your matter remains proportionate and cost effective. We will also discuss with you any Legal Expense Insurance that may provide cover, the free service provided by ACAS, payment plans and whether a “no win no fee” type agreement can be offered to you.
Costs will be dealt with in stages and will be agreed with you before any works are carried out. Where we can fix the fees to provide peace of mind on exact fees then we will do this. Throughout your matter settlement and dispute resolution will be considered and advised upon.
